Terms of Service for 꾸런 (kkurun)

Introduction

Welcome to 꾸런 (kkurun) - "Run Consistently" ("꾸준히 달리기"). These Terms of Service ("Terms") govern your access to and use of the kkurun mobile application ("App", "Service", or "kkurun").

By using kkurun, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

1.1 Agreement to Terms

By creating an account, downloading, installing, or using kkurun, you:

Confirm that you are at least 13 years old (or the age of majority in your jurisdiction)
Have read and understood these Terms
Agree to be legally bound by these Terms and our Privacy Policy
Represent that you have the authority to enter into this agreement

1.2 Changes to Terms

We reserve the right to modify these Terms at any time. We may, but are not obligated to, notify you of changes by:

Updating the "Last Updated" date at the top of this document
Posting in-app notifications for material changes (at our discretion)
Sending email notifications (if we have your email and choose to do so)

Your continued use of kkurun after changes become effective constitutes acceptance of the revised Terms, regardless of whether you received notice of the changes.

2. Description of Service

2.1 What kkurun Offers

kkurun is a mobile fitness tracking application that allows you to:

Track running and walking activities
Record workout data (distance, duration, pace, calories, etc.)
Upload workout screenshots from other fitness apps
Use AI-powered image recognition to extract workout data
Store workout history in the cloud
View personal statistics, records, and progress
Track workout streaks and consistency
Participate in group fitness challenges and rooms (feature availability may vary)
Compete on leaderboards (where available)

2.2 Service Availability

kkurun is provided "as is" and "as available"
We do not guarantee uninterrupted, timely, secure, or error-free service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice
We may perform maintenance that temporarily limits access to the Service
We have no obligation to provide support, updates, maintenance, bug fixes, or feature enhancements
This is a solo-operated service with limited resources; availability and responsiveness may vary

2.3 Service Termination

Right to Terminate Service:

We reserve the right to permanently shut down, discontinue, or terminate the Service (or any portion thereof) at any time, with or without notice, for any reason or no reason
This includes the right to permanently cease operations, deactivate all user accounts, and delete all user data
We have no obligation to provide advance notice of service termination; any notice provided is done so as a courtesy and is not guaranteed
We are not obligated to provide refunds, compensation, or alternative services upon termination

User Responsibilities:

You are solely responsible for maintaining backups of your data stored on kkurun
Upon notification of service termination (if provided), you should export any data you wish to retain
We strongly recommend regularly backing up your workout data and statistics
We are not responsible for any data loss that occurs as a result of service termination

No Obligation to Continue Service:

We have no obligation to continue operating or maintaining the Service
We may terminate the Service due to business, technical, legal, financial, personal, or any other reasons, including but not limited to lack of time, resources, interest, or viability
Termination of the Service does not create any liability or obligation on our part, except as otherwise required by law
As a solo-operated service, we reserve the right to discontinue the Service at any time without justification or explanation

3. User Accounts

3.1 Account Creation

Requirements:

You must provide a valid phone number for verification
You must create a unique username/nickname
You must provide accurate and complete information
You are responsible for maintaining the confidentiality of your account credentials

One Account Per User:

Each user may have only one account
Creating multiple accounts is prohibited and may result in termination

3.2 Account Security

You are responsible for:

Maintaining the security of your phone number and OTP codes
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breach

We are not liable for losses caused by unauthorized use of your account.

3.3 Account Suspension or Termination

We reserve the right to suspend or terminate your account, in our sole discretion, if:

You violate these Terms
You engage in fraudulent, abusive, or illegal activity
You create multiple accounts
You attempt to manipulate data or leaderboards
Your account is inactive for an extended period
We are required to do so by law
For any other reason we deem appropriate

We are under no obligation to provide warnings, explanations, or appeals for account termination decisions.

You may request termination of your account at any time by contacting us at kdevbrother@gmail.com, though we make no guarantees regarding the timing of such termination.

4. User Conduct & Prohibited Activities

4.1 Acceptable Use

You agree to use kkurun only for lawful purposes and in accordance with these Terms. You agree NOT to:

Data Integrity:

Submit false, misleading, or fraudulent workout data
Manipulate or falsify your statistics, records, or achievements
Use automated tools, bots, or scripts to generate fake workout data
Share or collude with others to artificially inflate statistics

Security & System Integrity:

Attempt to gain unauthorized access to our systems, servers, or databases
Interfere with or disrupt the Service or servers
Use any automated means to access the Service without our permission
Reverse engineer, decompile, or disassemble any part of the App
Circumvent security features or access controls

Content & Behavior:

Upload offensive, inappropriate, or illegal content (images, usernames, etc.)
Harass, bully, threaten, or abuse other users
Impersonate any person or entity
Spam other users or the Service
Violate any applicable laws or regulations

Intellectual Property:

Copy, reproduce, or distribute any part of the App without authorization
Use our trademarks, logos, or branding without permission
Infringe on our or others' intellectual property rights

4.2 Content You Upload

Ownership:

You retain ownership of the content you upload (workout images, data, etc.)
By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content as necessary to provide the Service

Responsibility:

You are solely responsible for the content you upload
You must have the right to upload and share the content
You must not upload copyrighted material without permission
You must not upload content that violates privacy rights of others

Content Moderation:

We reserve the right to review, remove, or refuse any content at our discretion
We may remove content that violates these Terms or is otherwise objectionable
We are not obligated to monitor or review user content

5. Intellectual Property Rights

5.1 Our Rights

The kkurun App, including all content, features, functionality, design, code, graphics, and trademarks, is owned by Solople and is protected by:

Copyright laws
Trademark laws
Patent laws (if applicable)
Other intellectual property laws

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install the App on your personal device
Use the App for personal, non-commercial purposes
Access and use the Service in accordance with these Terms

This license automatically terminates if you violate these Terms.

5.3 Restrictions

You may NOT:

Use the App for commercial purposes without our written permission
Modify, adapt, or create derivative works
Rent, lease, sell, or sublicense the App
Remove or alter any copyright, trademark, or proprietary notices

6. AI Image Processing & Data Extraction

6.1 AI Feature

kkurun uses artificial intelligence (Google Gemini API) to:

Analyze workout images you upload
Extract data (distance, duration, calories, pace, etc.) from images
Auto-populate workout records

6.2 Accuracy Disclaimer

AI extraction is provided as a convenience feature
Accuracy is not guaranteed and may vary
You are responsible for reviewing and correcting extracted data
We are not liable for inaccuracies in AI-extracted data

6.3 Your Consent

By uploading images for AI processing, you:

Consent to your images being processed by third-party AI services (Google Gemini)
Acknowledge that images may be transmitted to external servers for processing
Accept the risks associated with AI processing (see Section 8)

7. Challenge Rooms & Social Features

7.1 Participation

Challenge rooms and social features are optional
Participation is at your own discretion
You may leave challenge rooms at any time

7.2 Fair Play

When participating in challenges or leaderboards:

You must submit accurate, honest workout data
Cheating, data manipulation, or fraudulent behavior is strictly prohibited
We may disqualify users who violate fair play standards
We reserve the right to remove users from challenges or leaderboards

7.3 Interactions with Other Users

Be respectful and courteous to other users
Do not engage in harassment, bullying, or inappropriate behavior
Report violations to kdevbrother@gmail.com

We are not responsible for interactions between users or disputes that may arise.

8. Disclaimers & Limitations of Liability

8.1 No Warranties

KKURUN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Warranties of accuracy, reliability, or completeness
Warranties that the Service will be uninterrupted, timely, secure, or error-free
Warranties regarding the results of using the Service

8.2 Health & Fitness Disclaimer

IMPORTANT:

kkurun is NOT a medical device and is not intended for medical use
The App is for informational and motivational purposes only
Workout data, statistics, and calculations are estimates and may not be accurate
Consult a healthcare professional before starting any fitness program
We are not responsible for any health issues, injuries, or adverse effects resulting from your use of the App or participation in physical activities

You use kkurun at your own risk.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL
WE SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $100 IF YOU HAVEN'T PAID US ANYTHING)

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis.

8.4 Third-Party Services

kkurun uses third-party services (Google Gemini, cloud storage, hosting, etc.)
We are not responsible for the actions, errors, or failures of third-party services
Your use of third-party services is subject to their own terms and privacy policies

8.5 Data Loss

We implement reasonable measures to protect your data
However, we cannot guarantee against data loss due to technical failures, security breaches, service termination (see Section 2.3), or other unforeseen circumstances
You are responsible for maintaining your own backups of important data
In the event of service termination, shutdown, or discontinuation, all user data may be permanently deleted and may not be recoverable

9. Indemnification

You agree to indemnify, defend, and hold harmless Solople and its operator (the solo developer) from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use or misuse of kkurun
Your violation of these Terms
Your violation of any rights of another person or entity
Your content or data uploaded to the Service
Your violation of any applicable laws or regulations

10. Payments & Subscriptions

10.1 Current Pricing

As of the date of these Terms, kkurun is free to use and is supported by advertisements. We reserve the right to introduce:

Premium features or subscriptions (potentially ad-free versions)
In-app purchases
Other monetization methods

By using the app, you acknowledge that:

The app displays advertisements to support free access
Third-party advertising partners may collect data for ad personalization
You may have limited control over ad content (subject to our advertising standards)

If we introduce paid features, we will provide advance notice and updated terms.

10.2 Future Changes

We may change pricing at any time
Changes will not affect existing subscriptions until renewal
You may cancel subscriptions at any time before renewal

10.3 Service Termination and Refunds

In the event that we permanently terminate or shut down the Service (see Section 2.3), your access to the Service will cease
If you have an active paid subscription at the time of service termination, we may, at our sole discretion, provide a partial refund for the unused portion of your subscription
However, we are not obligated to provide refunds upon service termination
All subscription fees paid are generally non-refundable, except as required by applicable law or at our discretion

11. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, available at [PRIVACY POLICY URL].

By using kkurun, you consent to:

The collection and use of data as described in the Privacy Policy
The transfer and storage of your data as described
The use of third-party services that may process your data

12. Health Data

By granting health data permissions, you authorize 꾸런 to access workout information from Apple Health or Health Connect. This data is used solely to display and track your exercise activities. You can revoke this access at any time through your device settings.

13. International Use & Export Controls

13.1 Compliance with Laws

You are responsible for complying with all local laws and regulations
If you access kkurun from outside [YOUR COUNTRY], you do so at your own initiative
You are responsible for compliance with local laws regarding online conduct and data

13.2 Export Controls

You may not use, export, or re-export kkurun except as authorized by [YOUR COUNTRY] law
You represent that you are not located in a country subject to embargo
You are not listed on any prohibited or restricted party list

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14.2 Jurisdiction and Venue

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in the United States. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14.3 Informal Resolution

Before filing any formal legal proceeding, you agree to attempt to resolve any dispute informally by contacting us at kdevbrother@gmail.com. We are under no obligation to respond to or resolve disputes, but may choose to do so in good faith.

14.4 Class Action Waiver

YOU AGREE THAT ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. YOU HEREBY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding kkurun.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent
We may assign or transfer these Terms or our rights/obligations at any time without notice

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and us as a result of these Terms or your use of kkurun.

15.6 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to:

Acts of God, natural disasters, or extreme weather
War, terrorism, riots, or civil unrest
Government actions or regulations
Internet service provider failures or network outages
Pandemics or public health emergencies

15.7 Survival

Provisions that by their nature should survive termination of your account or the Service shall survive, including but not limited to:

Service Termination rights (Section 2.3)
Intellectual Property Rights (Section 5)
Disclaimers (Section 8)
Limitation of Liability (Section 8)
Indemnification (Section 9)
Data Loss disclaimers (Section 8.5)

You agree to be bound by these Terms and our Privacy Policy
You understand the disclaimers and limitations of liability
You accept the risks associated with using a fitness tracking app
You will use the Service responsibly and in accordance with these Terms

If you do not agree with any part of these Terms, you must immediately stop using kkurun.
