눈뜸이 이용약관

이 약관은 솔로플(Solople, 이하 "회사")이 제공하는 안드로이드 앱 "눈뜸이"(이하 "앱")의 이용 조건을 정합니다. 앱을 설치하거나 사용하면 이 약관에 동의한 것으로 봅니다. 동의하지 않으면 앱을 사용하지 마세요.

1. 가장 중요한 안내: 눈뜸이는 안전장치가 아닙니다

• 눈뜸이는 눈이 감긴 것을 감지해 알려 주는 보조 도구입니다. 졸음운전을 막거나 예방하지 않으며, 사고를 방지한다고 약속하지 않습니다.
• 앱은 눈이 감겨도 알리지 못할 수 있고, 눈을 뜨고 있어도 잘못 알릴 수 있습니다. 조명, 안경, 선글라스, 마스크, 휴대폰 위치, 얼굴 각도, 휴대폰 성능, 운영체제의 배터리 정책 등 여러 이유로 감지가 늦어지거나 멈출 수 있습니다.
• 앱은 자동차 안전 장비, 의료 기기, 졸음 측정 장비가 아니며 그 대체물도 아닙니다.
• 졸리면 운전하지 마세요. 안전한 곳에 차를 세우고 쉬는 것이 유일한 대책입니다. 앱이 알리지 않는다고 해서 운전해도 된다는 뜻이 아닙니다.
• 운전 중 휴대폰 화면을 보거나 조작하지 마세요. 앱은 출발 전에 켜고, 주행 중에는 손대지 않도록 만들어졌습니다.

2. 이용자의 책임

• 운전과 관련된 모든 판단과 책임은 운전자에게 있습니다. 앱의 알림 여부와 관계없이 이용자는 도로교통법 등 관련 법령을 지켜야 합니다.
• 휴대폰은 운전 시야를 가리지 않는 위치에 안전하게 거치해야 합니다.
• 앱은 만 18세 이상의 운전면허 소지자가 사용하는 것을 전제로 합니다.

3. 앱의 제공

• 앱은 무료로 제공되며 계정이 필요하지 않습니다.
• 앱은 인터넷에 연결하지 않으며, 카메라 영상을 저장하거나 전송하지 않습니다. 자세한 내용은 개인정보처리방침을 참고하세요.
• 회사는 앱의 기능을 예고 없이 바꾸거나, 업데이트하거나, 제공을 중단할 수 있습니다.

4. 지식재산권

앱과 그 구성요소에 대한 권리는 회사 또는 정당한 권리자에게 있습니다. 앱을 복제, 수정, 역설계, 재배포하거나 상업적으로 이용하려면 회사의 사전 서면 동의가 필요합니다.

5. 보증의 부인

앱은 "있는 그대로" 제공됩니다. 회사는 앱이 항상 정확하게 동작하거나, 중단 없이 실행되거나, 이용자의 특정 목적에 맞는다는 점을 보증하지 않습니다.

6. 책임의 제한

관련 법령이 허용하는 최대 범위에서, 회사는 앱의 사용 또는 사용 불능으로 발생한 사고, 부상, 사망, 재산 손해, 벌금, 기타 직접·간접·부수적·결과적 손해에 대해 책임을 지지 않습니다. 회사의 고의 또는 중대한 과실로 인한 손해는 예외로 하며, 소비자 관련 법령상 배제할 수 없는 권리는 이 조항의 영향을 받지 않습니다.

7. 약관의 변경

회사는 이 약관을 변경할 수 있으며, 변경된 약관은 이 페이지에 게시한 때부터 효력이 있습니다. 변경 후에도 앱을 계속 사용하면 변경에 동의한 것으로 봅니다.

8. 준거법

이 약관은 대한민국 법률에 따라 해석됩니다.

Nunddeumi Terms of Service (English)

These terms govern use of Nunddeumi ("the App"), an Android app by Solople. By installing or using the App you agree to them.

Nunddeumi is not a safety device. It is an aid that notifies you when it detects that your eyes have stayed closed. It does not prevent drowsy driving and does not promise to prevent accidents. It may fail to alert when your eyes are closed, and it may alert when they are open, because of lighting, glasses, sunglasses, masks, phone placement, face angle, phone performance, or the operating system stopping the App. It is not a vehicle safety system or a medical device, and it does not replace one. If you are sleepy, do not drive. Pull over somewhere safe and rest. Do not look at or handle the phone while driving; start the App before you set off.

You are responsible for all driving decisions and for complying with traffic law, whether or not the App alerts. Mount the phone where it does not block your view. The App is intended for licensed drivers aged 18 or older.

The App is free, needs no account, does not connect to the internet, and does not store or transmit camera images (see the Privacy Policy). Solople may change, update, or discontinue the App at any time. The App and its components are the property of Solople or its licensors; do not copy, modify, reverse engineer, or redistribute it without written permission.

The App is provided "as is" without warranty of accuracy, uninterrupted operation, or fitness for a particular purpose. To the fullest extent permitted by law, Solople is not liable for any accident, injury, death, property damage, fine, or other direct, indirect, incidental, or consequential damage arising from use of or inability to use the App, except for damage caused by Solople's willful misconduct or gross negligence and except for rights that consumer law does not allow to be excluded.
